Personal Search and Environmental Information Regulations requests

Please note that when submitting EIR search requests, it is the responsibility of the Search agent to clearly identify what searches they are requesting, and to ensure that the address and plans provided relate to the property which you wish to carry out the search on according to Leicester City Councils online mapping system.

What service you get from a EIR Request

  • Our officers will check that the search address and plan are valid.
  • We will provide information from the City Council which relates to the property/area which is indicated in the provided plan.
  • EIR requests will be turned around at the same pace as paid Land Charges Search requests.
  • We will produce a report detailing all requested data.

What service you won’t get from a EIR Request

  • If the search area shown on the plan differs from the City Councils mapping system, we will not query this, it is the Search agent’s responsibility to carry out these checks themselves and to be specific about the information they require.

Plan checks can be done by using the city councils online mapping system.

  • Leicester City Council Land Charges team will not analysis the data provided to ensure that the data it is pertinent to the search area, and we will not carry out further checks which are associated with the paid Land charges Search requests which we receive. This responsibility sits with the search agent.
  • Leicester City Council does not provide a guarantee that all information provided is correct. It is the search agent’s responsibility to check the information which has been requested.

Do we charge for EIR requests?

We do not currently provide facilities for Search agents to visit the council and check the Local Land Charges Register directly. For this reason, we provide personal searches free of charge.

CON29

While the council as a whole does not usually charge for EIR requests, Regulation 8 of the EIR provides that public authorities may charge for making environmental information available, as long as that charge is reasonable. Due to the nature of a CON29 under EIR property search request, the quantity of search requests of this type we receive and the resources that are required to ensure that we can provide this service in a timely manner which is comparable to other search requests which we deal with, we apply a basic fee of £25 plus VAT per EIR request.

Schedule of charges

Please note that this schedule of charges only applies to EIR information requests related too or substantially similar to any questions which are listed under CON29.

The council only charges for the time taken to locate, retrieve and extract the requested information and the costs incurred logging the request and issuing the result back to the requestee. It was determined that the processing of a standard CON29 under EIR property search from start to finish takes approximately one hour, we therefore decided to charge a flat rate based on the £25 hourly rate which was based on the hourly rate which is advised by the ICO when dealing with EIR requests. The fee that we require covers the following work carried out:

  • Validation of EIR request
  • Logging of EIR request
  • Departmental searches relating to the EIR request
  • Validation of departmental data
  • Correlation of all data provided into a report
  • Taking payment for cost of service
  • Issuing of report to requestee.

Paying for CON29 under EIR requests

The City Council is currently developing a process to require advance payment of charges in accordance with Regulation 8(4) (see ICO charging guidance) via our land charges portal. Until this process is developed, we will require payment to be taken over the phone via debit or credit card.

Please submit your search request as usual and once the search has been validated and is in progress, we will contact you to take payment. If you have submitted more than one search, we are happy to take payment for all outstanding searches at the same time.

If there are previous charges from your company which are outstanding, the search report will not be released until the previous charges are paid.
